In a move to protect the integrity of U.S. citizenship, President Trump signed two new executive orders on Thursday, Aug. 6, in an effort to permanently end “birth tourism” and limit birthright citizenship in the United States. Coming on the heels of the Supreme Court’s ruling in Trump v. Barbara, the new measures seek “to continue to protect the meaning and value of American citizenship,” according to a White House fact sheet. [snip] The second executive order specifically directed the banning of “birth tourism,” the practice of foreign nationals traveling to the U.S. on visitor visas solely to give birth and secure automatic U.S. citizenship for their newborns. Essentially, this order called upon the secretary of state, the secretary of homeland security, and the commissioner of Social Security to restrict such visas and enforce the order among all government departments so that “no one in the world is anymore allowed to obtain a visa for … fraudulent purposes,” according to senior advisor Stephen Miller. The number of people exploiting the practice of “birth tourism” in the U.S. is growing, with a recent estimate of 26,000 babies obtaining citizenship in this manner every year, according to the Migration Policy Institute. [snip] Additionally, in the summer of 2025, the Trump administration signed an executive order that similarly sought to deny birthright citizenship to U.S.-born children whose parents lacked U.S. citizenship or lawful permanent residency. According to the American Civil Liberties Union, “The Supreme Court has already decided the issue,” and that this new executive order will likely “meet the same fate as the last one.” Still others support Trump’s efforts and maintain that “birth tourism” is a major issue of fraud in the U.S., and enforcing strict visa rules falls squarely within the executive branch’s constitutional authority to protect national sovereignty.
