Another activist federal judge, in this case an Obama-appointed judge, just blocked President Trump from ending Temporary Protected Status for Somalians in the US. This despite the Supreme Court ruling that lower courts generally cannot block DHS ending TPS. Here’s more from Fox News: An Obama-appointed federal judge has issued yet another administrative stay blocking the Trump administration from ending Temporary Protected Status for Somalia — just days after a federal appeals court struck down similar stays for Ethiopia and South Sudan. [snip] Iowa Solicitor General Eric Wessan called the order legally indefensible, arguing four of the lawsuit’s five claims are foreclosed by the Supreme Court’s recent Mullin decision and describing the remaining claim as “frivolous.” Here’s the timeline: The Supreme Court ruled in June that lower courts generally cannot block TPS terminations based on non-constitutional claims. Days ago, the First Circuit reversed similar administrative stays issued by two other district judges who had delayed TPS terminations for Ethiopia and South Sudan. Then on July 30, plaintiffs in the Somalia case filed an amended complaint and emergency motion — rewriting their case around constitutional grounds in an attempt to survive the new legal landscape. [snip] The complaint also cites Trump’s past remarks describing Somali immigrants as “criminals,” “gang members,” and “low IQ” as evidence of racial and national-origin discrimination. Iowa Solicitor General Eric Wessan torched the ruling: “The district judge has entered a novel ‘administrative stay’ to sort out the claims.
