A Florida judge ordered an illegal immigrant who hijacked a plane from Cuba to Florida in 2003 to be released onto the streets, saying he’d been in Immigration and Customs Enforcement (ICE) custody for too long. [snip] On Monday, the Department of Homeland Security (DHS) decried the judge’s decision. “This activist judge forced ICE to release a criminal illegal alien who was convicted and sentenced to 22 years for hijacking a plane back into American communities,” DHS Acting Assistant Secretary Lauren Bis stated. [snip] “This is yet another example of an activist judge trying to thwart President Trump’s mandate from the American people to remove criminal illegal aliens from our country,” she added, vowing for the DHS to “continue to fight for the detention and removal of criminal illegal aliens who have no right to be in our country.” Guerra Morales was later found guilty of air piracy and conspiracy to interfere with the crew of a flight. He was initially sentenced to 22 years behind bars. He completed his sentence, then began removal proceedings. After a judge deferred his deportation to Cuba, ICE released him under supervision on March 1, 2023. He was arrested again on December 30, 2025, with plans to be moved to Mexico. [snip] “Respondents have had more than three years since Guerra Morales’s order of removal — and more than six months since his present detention — to remove him from the United States and are still unable to articulate a specific plan for his removal to Cuba, Mexico, or another country,” Steele wrote. “If removal becomes likely in the reasonably foreseeable future, ICE can re-detain,” he clarified.
