A 56-year-old woman was arrested outside of the Plymouth Superior Courthouse, where Lindsay Clancy has been on trial for weeks after she admitted to killing her three young children, according to Massachusetts State Police. [snip] Light was allegedly caught photographing or filming jurors, per media reports, though authorities have not released further details. [snip] After five weeks of testimony and nearly 300 pieces of evidence were exhibited, the jury is tasked with deciding if Clancy is guilty of murder or not guilty due to a case of severe postpartum psychosis. If the twelve jurors reach a deadlock for a second time, a Massachusetts judge can urge them to continue by reading them the “Tuey-Rodriguez charge,” which states: [snip] You should consider that it is desirable that the case [must at some time] be decided; that you are selected in the same manner, and from the same source, from which any future jury must be; and there is no reason to suppose that the case will ever be submitted to twelve [men] persons more intelligent, more impartial, or more competent to decide it, or that more or clearer evidence will be produced on the one side or the other. And with this view, it is your duty to decide the case, if you can conscientiously do so.” If these options are exercised and the trial still results in a hung jury, prosecutors have the option of retrying Clancy before a different jury.
